Legal Framework<\/h2>\n

The employer’s obligations with regard to training are laid down in national legislation at various levels:<\/p>\n

-Law 7\/2009, of February 12,<\/strong> in the 3rd Revision of the Labor Code, maintains the wording given in Law 7\/2009,of<\/strong> February 12, in its article 127, no. 1 – employer’s duties, point i):<\/p>\n

“(…) providing workers with the appropriate information and training to prevent occupational risks of accident or illness (…)” <\/p>\n

And in Article 131.
\n– continuous training, no.
\n2: “(…) the worker is entitled, each year, to a minimum number of forty hours of continuous training or, if hired for a fixed term of three months or more, a proportional minimum number of hours (…)”. <\/p>\n

The Legal Regime for the Promotion of Safety and Health at Work<\/strong>, Law 3\/2014, of January 28, which updated Law 102\/2009, of September 10, and which in article 20.
\nMaintains the wording given, determining the employer’s obligation to train workers, namely: <\/p>\n

1. “(…) adequate training in occupational health and safety, taking into account the job (…)”;<\/p>\n

2. “designated workers (…) must be guaranteed ongoing training for the performance of their duties”;<\/p>\n

3. “(…) the employer must train the sufficient number (…) of workers responsible for implementing first aid, fire-fighting and evacuation measures (…)”;<\/p>\n
