your employees. <\/p>\n<h2><strong>Frequently asked questions about Vocational Training and the Labor Code<\/strong><\/h2>\n<\/p>\n<h3><strong>Is the company legally obliged to provide professional training for its employees?<\/strong><\/h3>\n<p>Yes.<br \/>\nThe Labor Code specifies that all companies have an obligation to provide professional training for their employees.<br \/>\nThis training must <strong>qualify workers&nbsp; and ensure that they have access to ongoing training in the workplace.<\/strong>  <\/p>\n<p>The period of continuous training in the workplace provided for by law is <strong>40 hours per year<\/strong>.<br \/>\nIn the case of workers on fixed-term contracts lasting more than three months, the training hours are proportional to the length of their contract. <\/p>\n<h3><strong>Does the company have to provide vocational training to all employees at the same time?<\/strong><\/h3>\n<p>No.<br \/>\nThe legislation only stipulates that the employer must ensure <strong>ongoing training for at least 10% of the company&#8217;s employees<\/strong> every year. <\/p>\n<p>However, it is the company&#8217;s obligation to organize a <strong>training plan for its employees<\/strong>.<br \/>\nThis must take into account the 40 hours of compulsory training and must be consultable by its employees and their representatives. <\/p>\n<h3><strong>Is the employee obliged to attend vocational training offered by the company?<\/strong><\/h3>\n<p>Yes.<br \/>\nThe employee&#8217;s duties are set out in <strong><a href=\"https:\/\/dre.pt\/dre\/legislacao-consolidada\/lei\/2009-34546475-46733375\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">Article 128 of the Labor Code<\/a><\/strong> and include the obligation to actively participate in vocational training provided by the employer. <\/p>\n<p>This means that it is not only the company&#8217;s legal obligation to provide training, but workers are also obliged to attend it.<\/p>\n<h3><strong>Can compulsory vocational training take place outside of working hours?<\/strong><\/h3>\n<p>Yes.<br \/>\nThe company can organize vocational training outside of working hours and even during time off.<br \/>\nHowever, it must compensate the employee accordingly.<br \/>\nIf the training does not exceed two hours of work, it is paid at the normal rate.<br \/>\nHowever, if it does exceed two hours, it must be paid in accordance with overtime rules.    <\/p>\n<h3><strong>What happens in the event of default?<\/strong><\/h3>\n<p>Mandatory training that is not given to each employee is transformed into <strong>training credit<\/strong>.<br \/>\nAfter two years, this can be used by the employer to attend external training.<br \/>\nIf the employee terminates their contract before using their credit, they will be entitled to <strong>compensation for the missing training hours.<\/strong>  <\/p>\n<p>The supervisory body responsible is the Workers&#8217; Conditions Authority (ACT), which can impose fines if it considers that the law is not being complied with.<br \/>\nThese vary according to<strong> <a href=\"https:\/\/dre.pt\/dre\/legislacao-consolidada\/lei\/2009-34546475-46787675\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">Art. 554 of the Labor Code<\/a><\/strong>. <\/p>\n<h2><strong>What does the law say about Vocational Training?<\/strong><\/h2>\n<p>The employer&#8217;s obligations with regard to training are laid down in national legislation at various levels:<\/p>\n<ul>\n<li>\n<p><strong><a href=\"https:\/\/dre.pt\/dre\/legislacao-consolidada\/lei\/2009-34546475-124448605\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">law 7\/2009, of February 12th<\/a><\/strong><a href=\"https:\/\/dre.pt\/dre\/legislacao-consolidada\/lei\/2009-34546475-124448605\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">, <\/a><strong><a href=\"https:\/\/dre.pt\/dre\/legislacao-consolidada\/lei\/2009-34546475-124448605\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">Art<\/a><\/strong><a href=\"https:\/\/dre.pt\/dre\/legislacao-consolidada\/lei\/2009-34546475-124448605\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">. <\/a><strong><a href=\"https:\/\/dre.pt\/dre\/legislacao-consolidada\/lei\/2009-34546475-124448605\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">127, no. 1<\/a><\/strong><a href=\"https:\/\/dre.pt\/dre\/legislacao-consolidada\/lei\/2009-34546475-124448605\" rel=\"noopener noreferrer nofollow\" target=\"_blank\"> <\/a><strong><a href=\"https:\/\/dre.pt\/dre\/legislacao-consolidada\/lei\/2009-34546475-124448605\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">&#8211; employer&#8217;s duties, point i)<\/a><\/strong>&#8220;(&#8230;) <a href=\"https:\/\/dre.pt\/dre\/legislacao-consolidada\/lei\/2009-34546475-124448605\" rel=\"noopener noreferrer nofollow\" target=\"_blank\"> to<\/a> provide the worker with appropriate information and training to prevent occupational risks of accident or illness (&#8230;)&#8221;<\/p>\n<\/li>\n<li>\n<p><strong><a href=\"https:\/\/dre.pt\/dre\/legislacao-consolidada\/lei\/2009-34546475-124448606\" rel=\"noopener noreferrer nofollow\" target=\"_blank\"><g id=\"gid_0\">Law 7\/2009, of February 12, Art. 131.<\/g>  <\/a><\/strong> <a href=\"https:\/\/dre.pt\/dre\/legislacao-consolidada\/lei\/2009-34546475-124448606\" rel=\"noopener noreferrer nofollow\" target=\"_blank\"> &#8220;(&#8230;) the<\/a> worker is entitled, each year, to a minimum number of forty hours of continuous training or, if hired on a fixed-term basis for a period of three months or more, a proportional minimum number of hours (&#8230;)&#8221;<\/p>\n<\/li>\n<li>\n<p><strong><a href=\"https:\/\/dre.pt\/dre\/detalhe\/lei\/102-2009-490009\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">Law 3\/2014, of January 28, <\/a><\/strong><a href=\"https:\/\/dre.pt\/dre\/detalhe\/lei\/102-2009-490009\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">updated Law 102\/2009, of September 10, art.20:<\/a> maintains the wording given, determining the employer&#8217;s obligation, in terms of employee training, namely:<\/p>\n<ul>\n<li>\n<p>1. &#8220;(&#8230;) adequate training in occupational health and safety, taking into account the job (&#8230;)&#8221;;<\/p>\n<\/li>\n<li>\n<p>2. &#8220;designated workers (&#8230;) must be guaranteed ongoing training for the performance of their duties&#8221;;<\/p>\n<\/li>\n<li>\n<p>3. &#8220;(&#8230;) the employer must train the sufficient number (&#8230;) of workers responsible for implementing first aid, fire-fighting and evacuation measures (&#8230;)&#8221;;<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p><strong><a href=\"https:\/\/dre.pt\/dre\/detalhe\/decreto-lei\/50-2005-584397\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">Decree-Law 50\/2005 of February 25, art. 8:<\/a><\/strong> regulates the minimum health and safety requirements for workers when using work equipment and determines:&nbsp;<\/p>\n<ul>\n<li>\n<p>1- The employer must provide workers and their occupational health and safety representatives with adequate information about work equipment.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>SEPRI Training offers face-to-face training, synchronous distance <a href=\"https:\/\/training.sepri.pt\" rel=\"noopener noreferrer nofollow\">learning<\/a>(via zoom or teams) and asynchronous distance <a href=\"https:\/\/training.sepri.pt\" rel=\"noopener noreferrer nofollow\">learning<\/a>(via our <a href=\"https:\/\/training.sepri.pt\" rel=\"noopener noreferrer nofollow\">e-learning platform<\/a>).<br \/>\nContact us: <a href=\"mailto:comunicacao@sepri.pt\/\" rel=\"noopener noreferrer nofollow\">comunicacao@sepri.pt\/<\/a> <a href=\"https:\/\/www.google.com\/search?q=sepri&amp;oq=sepri+&amp;aqs=chrome..69i57j46i175i199i512j0i512j69i65l2j69i61j69i65j69i60.1473j0j7&amp;sourceid=chrome&amp;ie=UTF-8&amp;safe=active&amp;ssui=on\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">253 271&nbsp;<\/a> 525 . <\/p>\n<p>Read also: <a href=\"https:\/\/www.sepri.pt\/pt\/noticia\/ruido-no-trabalho-legisla%C3%A7ao-e-obriga%C3%A7oes-tudo-o-que-precisa-de-saber\" rel=\"noopener noreferrer nofollow\">Noise at work: legislation and obligations &#8211;
