{"id":2792,"date":"2023-09-07T11:22:44","date_gmt":"2023-09-07T10:22:44","guid":{"rendered":"https:\/\/sepri.pt\/noticia\/occupational-medicine-ive-had-an-accident-now-what\/"},"modified":"2023-09-07T11:22:44","modified_gmt":"2023-09-07T10:22:44","slug":"occupational-medicine-ive-had-an-accident-now-what","status":"publish","type":"post","link":"https:\/\/sepri.pt\/en\/noticia\/occupational-medicine-ive-had-an-accident-now-what\/","title":{"rendered":"Occupational medicine | I&#8217;ve had an accident.\nNow what?"},"content":{"rendered":"<p><a href=\"https:\/\/www.sepri.pt\/pt\/noticia\/seguran%C3%A7a-sa%C3%BAde-trabalho-braga-o-que-a-sua-empresa-deve-garantir\" rel=\"noopener noreferrer nofollow\">Accidents at work<\/a> stand out as events that can disrupt not only the <a href=\"https:\/\/www.sepri.pt\/pt\/noticia\/ginastica-laboral-empresas-beneficios-como-implementar\" rel=\"noopener noreferrer nofollow\">physical<\/a> and <a href=\"https:\/\/www.sepri.pt\/pt\/noticia\/avalia%C3%A7%C3%A3o-dos-riscos-profissionais\" rel=\"noopener noreferrer nofollow\">mental<\/a> <a href=\"https:\/\/www.sepri.pt\/pt\/noticia\/ginastica-laboral-empresas-beneficios-como-implementar\" rel=\"noopener noreferrer nofollow\">health of<\/a> workers, but also the operational dynamics of companies.<br \/>\nAs injured workers strive to recover, a crucial and challenging stage arises: returning to work after an accident. <\/p>\n<h3><strong>He had an accident at work.<br \/>\nYou&#8217;ve been discharged and are &#8220;cured without devaluation&#8221;.<br \/>\nWhat does that mean?  <\/strong><\/h3>\n<p>This means that you have been completely cured of your injuries and that they have left no permanent sequelae.<br \/>\nIn this case, the injured party will not be entitled to any kind of compensation for any disability.<br \/>\nThey may, however, be entitled to wage losses and any non-pecuniary damage.<br \/>\nWhen this happens, it is recommended that you seek a second opinion.<br \/>\nOf course, you should only do this if you experience difficulties that you didn&#8217;t have before in carrying out personal and\/or professional tasks.    <\/p>\n<h3><strong>He had an accident at work.<br \/>\nYou&#8217;ve been discharged and are &#8220;cured with devaluation&#8221;.<br \/>\nWhat does that mean?  <\/strong><\/h3>\n<p>The final indication of &#8220;cured with impairment&#8221; means that the injured person has achieved consolidation of their sequelae, but is still permanently affected with partial incapacity.<br \/>\nIn this case, the claimant is entitled to compensation for past, present and future property damage, biological damage, non-patrimonial damage and loss of income. <\/p>\n<p>Temporary incapacity for work is attributed whenever the accident results in functional limitations that totally or partially prevent the performance of professional tasks.<br \/>\nTemporary incapacity can be <strong>ABSOLUTE<\/strong> (ITA) in which the injured person does not work at all, or <strong>PARTIAL<\/strong> (ITP), in which the injured person works partially with a temporary limitation.<br \/>\nIn this case, the <a href=\"https:\/\/www.sepri.pt\/pt\/noticia\/medicina-do-trabalho-em-Portugal\" rel=\"noopener noreferrer nofollow\">Occupational Medicine<\/a> opinion will always be <strong>CONDITIONED FITNESS<\/strong> with the need for reassessment in the short term.<br \/>\nIt is important to find solutions in these cases to place the worker in a job that is compatible with their limitation.   <\/p>\n<p>The incapacity becomes <strong>Permanent Partial<\/strong> (PPI) if the accident results in sequelae that permanently affect the claimant&#8217;s ability to work.<br \/>\nIn this case, the supervision of occupational medicine is essential and the opinion will always be <strong>CONDITIONED APTITUDE<\/strong>, as definitive sequelae and injuries with implications for the claimant&#8217;s life have been recognized.<br \/>\nIt is up to Occupational Medicine, together with the Human Resources and Occupational Safety teams, to find a job that is compatible with the injured person&#8217;s situation.  <\/p>\n<p>If this is not possible, as well as in cases of <strong>Absolute Permanent Incapacity <\/strong>(IPA), 2 alternatives should be considered:<\/p>\n<ol>\n<li>\n<p>The recourse to the determination of an IPATH (Permanent and Absolute Incapacity for Habitual Work), in the Labor Court;<\/p>\n<\/li>\n<li>\n<p>There is very little use of early retirement procedures in the Social Security system.<\/p>\n<\/li>\n<\/ol>\n<p>In all these events, it is essential that the employer provides all the documentation relating to the event.<br \/>\nThe following information is essential: description of the accident + exact times of Temporary and Absolute Incapacity and Temporary Partial Incapacity + final decisions of discharge without devaluation or discharge with Permanent Partial Incapacity, both at the CGA\/Public Service and at the Labor Court. <\/p>\n<p>Read also: <a href=\"https:\/\/www.sepri.pt\/pt\/noticia\/medicina-do-trabalho-perguntas-frequentes\" rel=\"noopener noreferrer nofollow\">Occupational Medicine Braga: frequently asked questions<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Accidents at work stand out as events that can disrupt not only the physical and mental health of workers, but also the operational dynamics of companies.<br \/>\nAs injured workers strive to recover, a crucial and challenging stage arises: returning to work after an accident. <\/p>\n","protected":false},"author":1,"featured_media":3012,"comment_status":"closed","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"inline_featured_image":false,"footnotes":""},"categories":[],"tags":[],"class_list":["post-2792","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry"],"acf":[],"_links":{"self":[{"href":"https:\/\/sepri.pt\/en\/wp-json\/wp\/v2\/posts\/2792","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/sepri.pt\/en\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/sepri.pt\/en\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/sepri.pt\/en\/wp-json\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/sepri.pt\/en\/wp-json\/wp\/v2\/comments?post=2792"}],"version-history":[{"count":0,"href":"https:\/\/sepri.pt\/en\/wp-json\/wp\/v2\/posts\/2792\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/sepri.pt\/en\/wp-json\/wp\/v2\/media\/3012"}],"wp:attachment":[{"href":"https:\/\/sepri.pt\/en\/wp-json\/wp\/v2\/media?parent=2792"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/sepri.pt\/en\/wp-json\/wp\/v2\/categories?post=2792"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/sepri.pt\/en\/wp-json\/wp\/v2\/tags?post=2792"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
