The worker is discharged with the indication “cured with devaluation” when they are dealing with an accident at work in which recovery is not total, not complete.
We’re talking about situations such as the amputation of a finger, sequelae in terms of mobility, in other words, situations with more or less severity, but which are permanent sequelae for the worker.
In the event of being discharged with impairment, the worker is entitled to financial compensation which will be calculated on the basis of the legislation, the national disability table.
In essence, it will correspond to compensation for the loss of future earning capacity.
This financial compensation is awarded when the legislator understands and determines that the injured party has been affected and will therefore not be able to carry out their work to the full and their salary will be affected as a result.
This compensation will be determined by the insurer’s clinical services.
It can be contested by the claimant, if they so wish, but it will always be validated and the process will all be finalized in an employment tribunal, with the understanding and agreement of all parties involved.
