Training for companies – everything you need to know

Training for companies is a fundamental tool for the sustainable growth of organizations and the individual development of employees.
By complying with their legal obligations, companies can benefit from significant advantages such as increased productivity, improved quality and reduced costs.

Can I do online training?

The learning method can vary, depending on the type of training to be given.
At SEPRI, we adopt a hybrid approach and, for this reason, we offer professional training solutions in face-to-face, online and e-learning formats.

  1. Face-to-face: training takes place in training rooms or on the client’s premises, providing direct interaction between trainers and participants.

  2. Online Synchronous or E-learning: employees can access training content online, at flexible times, using digital resources.

  3. Hybrid Learning: combining face-to-face and online training to optimize learning.

What are the workers’ duties?

Workers also have duties when it comes to professional training.
According to the law, workers are obliged to attend training offered by the company.
O Article 128 of the Labour Code stipulates the obligation to actively participate in vocational training provided by the employer.

This means that it is not only the company’s legal obligation to provide training, but workers are also obliged to attend it.

Can the training take place outside working hours?

Yes.
Companies can carry out their training outside of working hours, or even on days off.
However, they are obliged to compensate the employee accordingly.
If the training lasts a maximum of two working hours, then they will be paid at the normal rate.
However, if it exceeds this, then they must be paid in accordance with overtime rules.

What happens if the company fails to comply with its legal obligations?

Mandatory training not administered to each employee is converted into training credits. After two years, these credits can be used by the employer to participate in external training activities.
If the employee terminates their contract before using the credits, they are entitled to compensation for the missing training hours.

Inspection is the responsibility of the Authority for Working Conditions (ACT), which can impose fines if it considers that the legislation is not being respected.
The fines vary according to Article 554 of the Labor Code.

What does the law say?

Law no. 7/2009 – establishes that employers with more than 10 employees must draw up and implement an annual training plan, which includes the identification of information needs, the objectives and the syllabus of the courses to be held.

  • Article 131 of the Labor Code – companies are obliged to provide their employees with ongoing training.
    Currently, the following are required  40 hours of training per year at least, 10% of employees.
    If the contract is for 3 months or more, the number of hours required per year is proportional to the length of the contract.

  • Article 130 of the Labor Code – vocational training has several objectives, such as:

    • Providing an initial qualification for a young person entering the job market without one;

    • Ensuring the ongoing training of the company’s employees;

    • To promote the professional qualification or retraining of a worker at risk of unemployment;

    • Promoting the professional rehabilitation of a disabled worker, particularly one whose disability is the result of an accident at work.

  • Article 266 of the Labor Code – if the training takes place outside working hours and/or on rest days, the company must compensate the employee for the hours spent on training.
    However,  up to 2 hours, on a working day, outside working hours, must be paid at the normal rate and are not considered overtime.

Law no. 102/2009 – establishes the legal framework for health and safety at work.
It stipulates that employers must guarantee training for their employees in the area of health and safety at work, as well as ensuring that workers are informed about the risks to their activities and the prevention and protection measures to be adopted.

Remember: it is important for workers to be aware of the importance of training for their personal and professional development, and to be willing to acquire new knowledge and skills that will enable them to meet the challenges of today’s job market.
